LOS MILICS WINE CLUB MEMBERSHIP TERMS AND CONDITIONS
1. Membership. Your membership includes you and another adult from the same household indicated at the time you enroll. To change that person, please send an email to wineclub@losmilics.com and use the subject line: “Wine Club Membership Change.” In the body of the email, please identify the new person to be included. One change is permitted per calendar year.
2. Cancellation. Any wine club membership cancelled before the first two annual shipments of wine have been shipped is subject to a cancellation fee. If the cancellation occurs before either shipment has occurred, the cancellation fee is $150. If the cancellation occurs after the first wine shipment, but before the second wine shipment has occurred, the cancellation fee is $100. When a cancellation fee is assessed, your credit card will be charged and you hereby expressly authorize us to charge your credit card for the applicable amount. If you need to cancel your membership, send an email to wineclub@losmilics.com and use the subject line: “Wine Club Membership Cancellation.”
3. Shipping Dates. The shipping dates described in your benefits are subject to change depending on the weather. We do not ship when the temperature could potentially damage the wine. This is most likely to occur between April and mid-October. Should the weather be too hot prior to your shipping date, the shipment may be delayed until the weather is suitable for shipping wine. Similarly, if temperatures are cooler, we may choose to ship somewhat early. We will notify you prior to sending each shipment.
4. Breakage upon receipt of wine. For replacement of damaged product, any breakage in shipping must be reported within three (3) days of receipt of the shipment. To notify us of breakage, please send an email to wineclub@losmilics.com and use the subject line: “Damaged Wine Club Shipment.” We will provide instructions when we are notified.
5. Returns. Requests for returns (excluding breakage replacements) must be made within fourteen (14) days of receipt of shipment. Requests for return will be considered on a case-by-case basis. To request a return, please send an email to wineclub@losmilics.com and use the subject line: “Wine Club Return Request.”
6. Failure to pick up shipment. We have limited storage space. Should any member elect to pick up her/his Wine Club shipment and fail to do so within thirty (30) days of receiving notice that their shipment is ready for pickup, the member’s credit card on file will be charged for the shipment unless the member had previously made an alternative arrangement with us.
7. Discounts. Wine Club members are entitled to a discount on bottled wine purchases to take away based on their membership tier. Discounts are not available on wine purchased by the glass or by the bottle to be consumed on premises. Third Leaf members also are entitled to a 10% discount on Los Milics Vineyards merchandise.
8. Access to Special Events and Private Chef Dinners. Wine Club members are afforded early access to invitations to special events and Private Chef Dinners. Availability of space is not guaranteed. If there are more requests for access to a special event or a Private Chef Dinner than space permits, requests will be accepted on an earliest-to-respond basis. Early access invitations will be organized as follows:
- a. Special Events
- i. Third Leaf members will get first access to special events. Once sent, these invitations will be held open for their responses for seven (7) days.
- ii. Following the initial seven (7) days, invitations for early access to special events will be sent to First Leaf and Second Leaf members. Once a First Leaf or Second Leaf member is sent an early access invitation to a special event, they will have a maximum of seven (7) days to accept it.
- b. Private Chef Dinners
- i. Third Leaf members will get first access to Private Chef Dinners. Once sent, these invitations will be held open for their responses for seven (7) days.
- ii. Following the initial seven (7) days, invitations for early access to Private Chef Dinners will be sent to Second Leaf members. Once a Second Leaf member is sent an early access invitation to a Private Chef Dinner, they will have a maximum of seven (7) days to accept it.
9. Disputes. We will make every reasonable effort to handle all complaints on an amicable basis. Should there be a dispute that cannot be resolved between us, any legal action brought against us must be initiated in a court of competent jurisdiction in the State of Arizona.
